1. Acceptance of Terms

By downloading, installing, or using FactFlick (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and BPA Solutions (“we”, “our”, or “us”).

2. Description of Service

FactFlick is a mobile trivia application that presents users with true/false statements across various knowledge categories. The App offers a free tier with 10 facts per day and 6 categories, as well as premium subscriptions that unlock unlimited play, all 12 categories, advanced statistics, and an ad-free experience.

3. Content Disclaimer

The facts and statements presented in FactFlick are intended for entertainment and educational purposes only. While we strive for accuracy, the content should not be considered professional advice in any field, including but not limited to medicine, law, science, or economics. We make no guarantees about the absolute accuracy of any individual fact.

3. Eligibility

FactFlick is suitable for users of all ages. If you are under 18, we recommend using the App with guidance from a parent or guardian. By using the App, you represent that you have the necessary permissions to do so.

4. User Accounts and Access

FactFlick does not require you to create an account. Access is managed through your device, and subscription status is tied to your Apple ID. You are responsible for maintaining the security of your device and Apple ID.

5. Subscriptions and Payments

• Free Tier: FactFlick offers a free tier that includes 10 facts per day, 6 categories, basic stats, and streak tracking.
• Subscription Plans: Premium access is available through paid subscriptions:
  • Monthly: $3.99/month
  • Yearly: $39.99/year (save 17%)
• Lifetime Purchase: A one-time purchase of $99.99 grants permanent Premium access.
• Billing: All payments are processed through the Apple App Store. By subscribing, you agree to Apple's payment terms.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
• Price Changes: We reserve the right to change subscription prices. You will be notified in advance and given the option to cancel before the new price takes effect.

6. Intellectual Property

The App itself, including its design, code, branding, logos, fact database, and user interface, is the intellectual property of BPA Solutions and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or reverse-engineer the App.

7. Acceptable Use

You agree not to:

• Attempt to bypass usage limits, manipulate the system, or abuse the service
• Reverse-engineer, decompile, or attempt to extract the source code of the App
• Use automated tools, bots, or scripts to interact with the App
• Redistribute, resell, or sublicense access to the App or its content

We reserve the right to restrict or terminate access for users who violate these terms.

8. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted, timely, secure, or error-free operation
• Accuracy or completeness of fact content
• Compatibility with your specific device or iOS version

9. Limitation of Liability

To the maximum extent permitted by applicable law, BPA Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to:

• Loss of data or game progress
• Service interruptions or downtime
• Unauthorized access to your device or data

Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim, or $50, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless BPA Solutions, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

11. Service Availability

We strive to keep FactFlick available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We reserve the right to modify, suspend, or discontinue the App at any time without prior notice.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised “Last updated” date. Continued use of the App after changes constitutes acceptance of the updated Terms. For material changes, we will provide notice within the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Toulouse, France.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
