1. Acceptance of Terms

By downloading, installing, or using FileSnap (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and BPA Solutions (“we”, “our”, or “us”).

2. Description of Service

FileSnap is a mobile application designed for professional file conversion on iPhone and iPad. The App converts between PNG, JPEG, HEIC, WebP, and PDF formats. All file processing happens entirely on your device with no cloud uploads or server connections.

The free tier includes 5 core conversion tools with 3 conversions per day. The Pro upgrade ($4.99 one-time purchase) unlocks all tools and unlimited conversions.

3. Eligibility

FileSnap is suitable for users of all ages. The App requires an iPhone or iPad running iOS 18 or later. By using the App, you represent that you have the necessary permissions to do so.

4. User Accounts and Access

FileSnap does not require you to create an account. There is no login, no registration, and no personal information required. Pro purchase status is tied to your Apple ID and managed through Apple StoreKit.

5. Purchases and Payments

• Free Tier: 5 core conversion tools (PNG to JPEG, Image to PDF, PDF to Images, HEIC Converter, WebP Converter) with 3 conversions per day. Free forever, no purchase required.
• Pro Purchase ($4.99): A one-time, non-recurring purchase that permanently unlocks Merge PDFs, Image Compressor, Batch Mode, and unlimited daily conversions. This is not a subscription.
• Billing: The Pro purchase is processed through the Apple App Store. By purchasing, you agree to Apple's payment terms.
• No Subscription: FileSnap Pro is a one-time purchase. There are no recurring charges, no auto-renewal, and no subscription management needed. Pay once, use forever.
• Refunds: Refund requests are handled by Apple through the App Store. We do not process refunds directly.
• Price Changes: We reserve the right to change the Pro purchase price. Any price changes will not affect users who have already purchased Pro.

6. File Processing Disclaimer

FileSnap processes files locally on your device using native iOS frameworks. While we strive for accurate and high-quality conversions, we do not guarantee that:

• Converted files will be identical to the originals in every detail
• All file variations within supported formats will convert without issues
• Output quality will meet every specific use case requirement

We recommend keeping your original files until you have verified that the conversion meets your needs.

7. Intellectual Property

Your Files: You retain full ownership and all rights to any files you convert using FileSnap. We do not claim any rights to your content. Since all processing is local, we never have access to your files.

Our Content: The App itself, including its design, code, branding, logos, and user interface, is the intellectual property of BPA Solutions and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or reverse-engineer the App.

8. Acceptable Use

You agree not to:

• Attempt to bypass usage limits, manipulate the system, or abuse the service
• Reverse-engineer, decompile, or attempt to extract the source code of the App
• Use automated tools, bots, or scripts to interact with the App
• Redistribute, resell, or sublicense access to the App or its functionality

We reserve the right to restrict or terminate access for users who violate these terms.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted, timely, secure, or error-free operation
• Accuracy or completeness of file conversions
• Compatibility with your specific device or iOS version

10. Limitation of Liability

To the maximum extent permitted by applicable law, BPA Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to:

• Loss of data or corrupted files
• Inaccurate file conversions
• Service interruptions or App crashes

Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid us (up to $4.99), or $10, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless BPA Solutions, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

12. Service Availability

Since FileSnap processes everything locally on your device, the App functions without an internet connection. However, we reserve the right to modify, update, or discontinue the App at any time. Pro purchase restoration requires a connection to the App Store.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised “Last updated” date. Continued use of the App after changes constitutes acceptance of the updated Terms. For material changes, we will provide notice within the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Toulouse, France.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
