Terms of Service

1. Acceptance of Terms

By downloading, installing, or using WallCraft AI (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and BPA Solutions (“we”, “our”, or “us”).

2. Description of Service

WallCraft AI is a mobile application that uses artificial intelligence to generate wallpaper images based on text descriptions provided by users. The App offers both free and paid subscription tiers.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.

4. User Accounts and Access

WallCraft AI does not require you to create an account. Access is managed through your device, and subscription status is tied to your Apple ID. You are responsible for maintaining the security of your device and Apple ID.

5. Subscriptions and Payments

• Free Tier: All users may generate up to 3 wallpapers per day at no cost.
• Pro Subscription: Unlimited wallpaper generation is available through a paid subscription at the following rates:
  • Weekly: $4.99/week
  • Monthly: $9.99/month
  • Yearly: $49.99/year
• Billing: All payments are processed through the Apple App Store. By subscribing, you agree to Apple's payment terms.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
• Price Changes: We reserve the right to change subscription prices. You will be notified in advance and given the option to cancel before the new price takes effect.

6. Intellectual Property

Your Content: You retain full ownership of the wallpapers generated through your use of the App. You are free to use, share, modify, and distribute your generated wallpapers for any personal or commercial purpose.

Our Content: The App itself, including its design, code, branding, logos, and user interface, is the intellectual property of BPA Solutions and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or reverse-engineer the App.

AI-Generated Content: While you own the output, we make no guarantees regarding the uniqueness of generated images. Similar prompts may produce similar results for different users.

7. Acceptable Use

You agree not to use WallCraft AI to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate content that infringes on the intellectual property rights of others
• Generate content depicting real individuals without their consent
• Attempt to bypass usage limits, manipulate the system, or abuse the service
• Reverse-engineer, decompile, or attempt to extract the source code of the App
• Use automated tools, bots, or scripts to interact with the App

We reserve the right to restrict or terminate access for users who violate these terms.

8. Content Moderation

Our AI provider may apply content filters to prevent the generation of certain types of images. We are not responsible for content that is blocked by these filters. We reserve the right to review and moderate generated content and to update content policies at any time.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted, timely, secure, or error-free operation
• Accuracy, reliability, or quality of generated content
• Compatibility with your specific device or iOS version

AI-generated images may not always match your expectations. Results depend on the specificity and clarity of your prompts.

10. Limitation of Liability

To the maximum extent permitted by applicable law, BPA Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to:

• Loss of data, revenue, or profits
• Service interruptions or downtime
• Content generated by the AI that is inaccurate, offensive, or unusable
• Unauthorized access to your device or data

Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim, or $50, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless BPA Solutions, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

12. Service Availability

We strive to keep WallCraft AI available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We reserve the right to modify, suspend, or discontinue the App at any time without prior notice.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised “Last updated” date. Continued use of the App after changes constitutes acceptance of the updated Terms. For material changes, we will provide notice within the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Toulouse, France.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
